Please read these Terms of Service ("Terms") carefully before using the BinBuddies platform, website, or mobile application operated by BinBuddies LLC ("BinBuddies," "we," "our," or "us"). By accessing or using our services, you agree to be bound by these Terms. If you do not agree, do not use our services.
IMPORTANT: THESE TERMS CONTAIN A BINDING ARBITRATION CLAUSE AND CLASS ACTION WAIVER IN SECTION 18. PLEASE READ THEM CAREFULLY — THEY AFFECT YOUR LEGAL RIGHTS.
BinBuddies LLC is a technology-enabled platform that connects customers ("Customers") who need residential trash and recycling bin management services with independent service providers ("Buddies") who perform those services. BinBuddies is not a waste management company. We provide the platform and logistics technology that facilitates these connections. All bin management services are performed by Buddies who are independent contractors, not employees of BinBuddies LLC.

By using BinBuddies, you represent and warrant that you meet all eligibility requirements. We reserve the right to refuse service to anyone for any reason at any time.

We reserve the right to suspend or terminate your account at our sole discretion, including for violation of these Terms, fraudulent activity, or conduct that harms other users or the BinBuddies platform.
BinBuddies currently offers the following service plans in the Greater Birmingham, Alabama area:
Service availability, scheduling, and coverage areas are subject to change. BinBuddies does not guarantee service in all locations. We will make reasonable efforts to notify you of any changes to your service.
Service is scheduled based on your municipality's collection calendar. You are responsible for providing accurate pickup day information. BinBuddies is not responsible for missed collections resulting from incorrect schedule information provided by the Customer.
In the event a Buddy is unable to complete a scheduled service visit, BinBuddies will make commercially reasonable efforts to dispatch a backup Buddy or issue a service credit to your account. BinBuddies does not guarantee completion of every individual service visit.
Customers are responsible for ensuring bins are accessible. If a Buddy cannot access your bins due to locked gates, obstructions, or hazardous conditions, the visit may be skipped without credit or refund.
By subscribing to a BinBuddies service plan, you authorize us to charge your payment method on file on a monthly basis. Charges are processed through our third-party payment processor, Stripe, Inc. By providing payment information, you also agree to Stripe's terms of service.
BinBuddies does not store your full payment card information. All payment data is handled securely by Stripe in accordance with PCI DSS standards.
You may cancel your BinBuddies subscription at any time through your account settings or by contacting us at [email protected] or 205-789-0825. Cancellation takes effect at the end of your current billing cycle. You will continue to receive service through the end of the paid period.
BinBuddies does not provide prorated refunds for partial months of service. If you cancel mid-month, you retain access to service through the end of that billing period.
BinBuddies reserves the right to cancel or suspend your service at any time for violation of these Terms, non-payment, or conduct deemed harmful to Buddies, other Customers, or the platform.
Buddies are independent contractors, not employees, agents, or partners of BinBuddies LLC. BinBuddies does not control the manner or means by which Buddies perform services, except as necessary to maintain platform standards. BinBuddies is not responsible for the acts or omissions of Buddies beyond what is described in these Terms.
Buddies are solely responsible for their own taxes, insurance, tools, and compliance with applicable laws. Nothing in these Terms creates an employment relationship between BinBuddies and any Buddy.

Violation of this section may result in immediate account termination without refund.
As part of our service, Buddies may capture photos of your bins and property as confirmation of completed service. These photos may be stored on BinBuddies' systems and shared with you through the platform. By using our service, you consent to this photography. Photos are used solely for service verification and quality assurance purposes.
By scheduling service, you grant Buddies a limited license to access the areas of your property reasonably necessary to perform the requested services. You represent that you have the legal right to grant such access.
BinBuddies and its Buddies are not responsible for pre-existing property damage. Any claims of damage caused during service must be reported to BinBuddies within 24 hours of the service visit. BinBuddies will investigate and, at its sole discretion, determine whether any remedy is appropriate.
All content, trademarks, logos, software, and technology associated with the BinBuddies platform are owned by or licensed to BinBuddies LLC. You may not copy, reproduce, distribute, or create derivative works from any BinBuddies content without our express written permission.
You grant BinBuddies a non-exclusive, royalty-free license to use any feedback, reviews, or content you submit through the platform for operational and marketing purposes.
Your use of BinBuddies is also governed by our Privacy Policy, which is incorporated into these Terms by reference. By using our services, you consent to the collection and use of your information as described in the Privacy Policy.
THE BINBUDDIES PLATFORM AND SERVICES ARE PROVIDED "AS IS" AND "AS AVAILABLE" WITHOUT WARRANTIES OF ANY KIND, EITHER EXPRESS OR IMPLIED, INCLUDING BUT NOT LIMITED TO IMPLIED WARRANTIES OF MERCHANTABILITY, FITNESS FOR A PARTICULAR PURPOSE, AND NON-INFRINGEMENT.
BINBUDDIES DOES NOT WARRANT THAT THE PLATFORM WILL BE UNINTERRUPTED, ERROR-FREE, OR FREE OF VIRUSES OR OTHER HARMFUL COMPONENTS. BINBUDDIES DOES NOT WARRANT THE QUALITY, SAFETY, OR SUITABILITY OF ANY BUDDY OR SERVICE PERFORMED THROUGH THE PLATFORM.
TO THE MAXIMUM EXTENT PERMITTED BY APPLICABLE LAW, BINBUDDIES LLC, ITS OFFICERS, DIRECTORS, EMPLOYEES, AND AGENTS SHALL NOT BE LIABLE FOR ANY INDIRECT, INCIDENTAL, SPECIAL, CONSEQUENTIAL, OR PUNITIVE DAMAGES, INCLUDING LOSS OF PROFITS, DATA, OR GOODWILL, ARISING OUT OF OR IN CONNECTION WITH YOUR USE OF THE PLATFORM OR SERVICES, EVEN IF ADVISED OF THE POSSIBILITY OF SUCH DAMAGES.
IN NO EVENT SHALL BINBUDDIES' TOTAL LIABILITY TO YOU FOR ALL CLAIMS EXCEED THE GREATER OF (A) THE TOTAL AMOUNT YOU PAID TO BINBUDDIES IN THE THREE (3) MONTHS PRECEDING THE EVENT GIVING RISE TO THE CLAIM, OR (B) ONE HUNDRED DOLLARS ($100).
SOME JURISDICTIONS DO NOT ALLOW THE EXCLUSION OR LIMITATION OF LIABILITY FOR CONSEQUENTIAL OR INCIDENTAL DAMAGES, SO THE ABOVE LIMITATION MAY NOT APPLY TO YOU.
You agree to defend, indemnify, and hold harmless BinBuddies LLC and its officers, directors, employees, contractors, and agents from and against any claims, liabilities, damages, losses, and expenses, including reasonable attorneys' fees, arising out of or in any way connected with: (a) your access to or use of the platform; (b) your violation of these Terms; (c) your violation of any third-party rights; or (d) any content you submit to the platform.
These Terms are governed by and construed in accordance with the laws of the State of Alabama, without regard to its conflict of law principles. To the extent any dispute is not subject to arbitration as set forth in Section 18, you consent to the exclusive jurisdiction of the state and federal courts located in Jefferson County, Alabama.

Informal Resolution. Before initiating any formal dispute process, you agree to contact BinBuddies at [email protected] and provide a written description of your dispute. We will attempt to resolve the dispute informally within 30 days.
Binding Arbitration. If informal resolution fails, you and BinBuddies agree that any dispute, claim, or controversy arising out of or relating to these Terms or your use of the platform — including questions of arbitrability — shall be resolved exclusively through binding individual arbitration administered by the American Arbitration Association ("AAA") under its Consumer Arbitration Rules, rather than in court.
Class Action Waiver. YOU AND BINBUDDIES AGREE THAT EACH MAY BRING CLAIMS AGAINST THE OTHER ONLY IN YOUR OR ITS INDIVIDUAL CAPACITY AND NOT AS A PLAINTIFF OR CLASS MEMBER IN ANY PURPORTED CLASS, COLLECTIVE, OR REPRESENTATIVE PROCEEDING. The arbitrator may not consolidate more than one person's claims.
Exceptions. Either party may bring an individual claim in small claims court. Either party may seek emergency injunctive relief in a court of competent jurisdiction to prevent irreparable harm pending arbitration.
Arbitration Fees. For claims under $10,000, BinBuddies will pay all AAA filing, administration, and arbitrator fees unless the arbitrator finds your claim frivolous.
Opt-Out. You may opt out of this arbitration agreement by sending written notice to [email protected] within 30 days of first accepting these Terms. Your notice must include your name, address, and a clear statement that you wish to opt out of arbitration. Opting out does not affect any other provisions of these Terms.
We reserve the right to modify these Terms at any time. When we make material changes, we will notify you by email or by posting a notice on the platform at least 14 days before the changes take effect. Your continued use of the platform after the effective date constitutes your acceptance of the revised Terms.
If you do not agree to the updated Terms, you must stop using the platform and cancel your subscription before the effective date.
If any provision of these Terms is found to be invalid or unenforceable by a court or arbitrator of competent jurisdiction, that provision shall be enforced to the maximum extent permissible and the remaining provisions shall remain in full force and effect.
These Terms, together with our Privacy Policy and any additional terms applicable to specific services, constitute the entire agreement between you and BinBuddies LLC with respect to your use of the platform and supersede all prior agreements, representations, and understandings.
